Last Will and Testament of Jeremiah Layman

Shelby Co., OH Probate Court (A-2234).

"I, Jeremiah Layman, of Orange Township in the County of Shelby and State of Ohio, do hereby make and publish this my last will and testament hereby revoking all wills or parts of wills, by me at any time heretofore made.

Item 1st: I give and bequeath to Jane Berry the house and lot of about three fourths of an acre now occupied by her on the East half of the North West quarter of Section 4 Town 1 Range 12 together with the present means of ingress
and regress, so long as she remains a widow and continues to occupy the same as a residence,

Item 2nd: I give and bequeath to my daughter-in-law, now Leah Barr, who was the lliam C., the residue of said East half of the North West quarter of Section 4 Town 1 Range 12 during her natural life. She paying all taxes and assessments in said land and provided she shall continue to live on and occupy the same,

Item 3rd: I give and bequeath to my daughters Eliza Voorhes and Aney Belsford their heirs and assigns the West half of the South East quarter of Section 5 Town 1 Range 12,
(note: the handwriting makes it impossible to differentiate between the name "Aney" and "Amy")

Item 4th: I give and bequeath to my grand son Lewis F. Layman on his attaining the age of twenty one years to him his heirs and assigns the East half and 40 acres off of the North end of the West half of the North East quater of Section 4 Town 1 Range 12. I also give to the said Lewis F. Layman his heirs and assigns the East half of the North West quarter of Section 4 Town 1 Range 12 after the determination of the particular estates in the same herein above devised, to Leah Barr and Jane Berry,

Item 5th: I give and bequeath to my niece Susan F. Kiser Sixty Acres of land off of the South part of the North West quarter of Section Thirty from Town Two Range Twelve except the following tract, beginning at the south west corner of
said quarter then east 53-1/3 rods. Thence north 30 rods, Thence west 53-1/3 rods, Thence south to the place of beginning containing ten acres, to her, the said Susan her heirs and assigns forever. I also give and bequeath to the said Susan F. Kiser the use of the north east quarter of section 4 Town 1 Range 12 except the South west fourth thereof, untill my said grand son Lewis F. Layman
attains the age of Twenty one years, she at her own proper expense and charges keeping said premises in good repair paying all the taxes and assessments theron, and shall from and after five years from my decease, annually pay to
the legal guardian of the said Lewis F. Layman for the use of the said Lewis the sum of Two hundred dollars ($200) per year untill the said Lewis attains the age of Twenty one, on the failure of the said Susan to comply with these
requisitions the gaurdian of said Lewis to take possession of said premises and manage the same for the best interest of the said Lewis, untill he becomes of age,

Item 6th: I give and bequeath all my personal estate to my legal heirs to be divided amongst them by familys or stocks, and desire the same to be amicably divided by them without appraisement or sale, minors if any being represented by their legal guardians.

In testimony whereof I have hereunto set my hand and seal this Twenty first day of May A. D. 1872.
